Delays caused by your failure to provide required materials or feedback may result in project timeline extensions and are not grounds for a refund.
Upon receipt of full payment, you will own the final website design and all custom content created specifically for your project. We retain the right to display your completed website in our portfolio and marketing materials unless you request otherwise in writing.
We retain ownership of any proprietary tools, frameworks, code libraries, or templates used in the development of your website. Third-party software, plugins, or stock assets incorporated into your website are subject to their respective licenses.
You represent and warrant that you own or have the right to use all content, images, and materials you provide to us for inclusion in your website.
Each project includes a specified number of revision rounds as outlined in your project agreement (typically two rounds for standard packages). Revisions are defined as reasonable adjustments to the approved design — changes in direction, scope, or content that materially alter the original brief may be treated as new work and billed accordingly.
Revision requests must be submitted in writing (email is acceptable) within 7 days of receiving a design preview. Requests submitted after this window may be treated as new work.
Where we arrange hosting and domain registration on your behalf, you acknowledge that these are third-party services subject to their own terms and fees. We will provide you with full access credentials upon project completion. You are responsible for renewing your domain registration and hosting plan after the initial period covered by your package.
We are not liable for downtime, data loss, or service interruptions caused by third-party hosting providers.
To the fullest extent permitted by applicable law, Local Lift Web shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website, including but not limited to loss of revenue, loss of data, or loss of business opportunities, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to us in the three months preceding the claim.
Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that your website will be error-free, uninterrupted, or free from viruses or other harmful components. We do not guarantee any specific results from your website, including search engine rankings, traffic levels, or revenue.
You agree to indemnify, defend, and hold harmless Local Lift Web and its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of our services, or any content you provide to us.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.
