Terms of Service

These Terms of Service ("Terms") govern your use of the website located at https://websellagcy.com and the web design and development services provided by Local Lift Web ("we," "us," or "our"). By accessing our Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. Services

Local Lift Web provides custom website design and development services for local businesses, including but not limited to website design, website development, SEO setup, and website maintenance plans. The specific scope of services, deliverables, timelines, and pricing for each project will be agreed upon in writing prior to commencement of work.

We reserve the right to refuse service to anyone for any reason at any time. We may also modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

2. Payment Terms

Payment terms are as follows unless otherwise agreed in writing:

  • One-time packages (Starter, Business Pro): Full payment is due upon project completion and your approval of the final website, prior to the site going live. We accept payment via Stripe (credit/debit card).
  • Monthly maintenance plans: Billed monthly on a recurring basis. You may cancel at any time with 30 days' written notice. No refunds are issued for partial months.
  • Late payments: Invoices unpaid after 14 days may result in suspension of services or removal of the delivered website until payment is received.

All prices are listed in U.S. dollars. You are responsible for any applicable taxes.

3. Refund Policy

Because our services involve significant custom labor, our refund policy is as follows:

  • If you cancel a project before we have begun design work, you are entitled to a full refund.
  • If you cancel after design work has commenced but before the final website is delivered, a partial refund may be issued at our discretion based on work completed.
  • Once a completed website has been delivered and approved by you, no refunds will be issued.
  • Monthly maintenance plan fees are non-refundable once a billing cycle has begun.

4. Client Responsibilities

To deliver your project on time, we require your cooperation. You agree to:

  • Provide all necessary content, images, logos, and materials within the timeframe specified in your project agreement
  • Respond to design previews and revision requests in a timely manner (typically within 5 business days)
  • Ensure that any content or materials you provide do not infringe upon the intellectual property rights of any third party
  • Provide accurate business information for use on your website

Delays caused by your failure to provide required materials or feedback may result in project timeline extensions and are not grounds for a refund.

5. Intellectual Property

Upon receipt of full payment, you will own the final website design and all custom content created specifically for your project. We retain the right to display your completed website in our portfolio and marketing materials unless you request otherwise in writing.

We retain ownership of any proprietary tools, frameworks, code libraries, or templates used in the development of your website. Third-party software, plugins, or stock assets incorporated into your website are subject to their respective licenses.

You represent and warrant that you own or have the right to use all content, images, and materials you provide to us for inclusion in your website.

6. Revisions

Each project includes a specified number of revision rounds as outlined in your project agreement (typically two rounds for standard packages). Revisions are defined as reasonable adjustments to the approved design — changes in direction, scope, or content that materially alter the original brief may be treated as new work and billed accordingly.

Revision requests must be submitted in writing (email is acceptable) within 7 days of receiving a design preview. Requests submitted after this window may be treated as new work.

7. Hosting and Domain

Where we arrange hosting and domain registration on your behalf, you acknowledge that these are third-party services subject to their own terms and fees. We will provide you with full access credentials upon project completion. You are responsible for renewing your domain registration and hosting plan after the initial period covered by your package.

We are not liable for downtime, data loss, or service interruptions caused by third-party hosting providers.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Local Lift Web shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or website, including but not limited to loss of revenue, loss of data, or loss of business opportunities, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or our services shall not exceed the total amount paid by you to us in the three months preceding the claim.

9. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that your website will be error-free, uninterrupted, or free from viruses or other harmful components. We do not guarantee any specific results from your website, including search engine rankings, traffic levels, or revenue.

10. Indemnification

You agree to indemnify, defend, and hold harmless Local Lift Web and its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms, your use of our services, or any content you provide to us.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Effective Date" at the top of this page. Your continued use of our Site or services after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.
